AN engineer has been given a five year suspended sentence after he was caught distributing performance enhancing steroids having bought them legally online.
Edgars Vilkys (28), originally from Lithuania, pleaded guilty at Dublin Circuit Criminal Court to possession of mephedrone, trilfluromethylphenylpiperazne and testosterone propionate at his home for sale or supply in Connaught Street, Phibsboro on May 19, 2011.
The court heard that the drugs had a total street value of €56,000 and had been made illegal the previous August under The Psychotropic Substances Act 2010.
Vilkys and another man were intending to set up a website to allow for the easier distribution of these drugs and had already registered an email address.
Judge Mary Ellen Ring said while she was satisfied that Vilkys had initially got involved in the use of these drugs when they were still legal, he knew they were illegal at the time of his arrest and had got involved in distributing them in order to make money.
She said the effect of these drugs could be very dangerous on the users. She said it was “particularly disturbing” that young people had started to take the testosterone propionate and other similar drugs as a steroid so as to enhance their abilities in competing in sports.
Judge Ring also said the nature of these drugs and the development of them meant that both gardaí and the legislature had to continually be one step ahead of dealers like Vilkys.
She accepted that Vilkys had no previous convictions and had co-operated with the garda investigation but said she could not ignore the serious affect these drugs have on “users and the community in general”.
Judge Ring imposed a five year sentence which she suspended in full on strict conditions including that Vilkys be of good behaviour for five years.
Garda Brian Hunt told Shane Costelloe BL, prosecuting, that Vilkys was not in his house when gardaí searched it and discovered the drugs.
He later arrived at the house and took responsibility for the haul. A further quantity of mephedrone was found in the boot of the car he had arrived in.
Vilkys told gardaí he had bought the drugs legally online and accepted he knew they were now illegal. He said he did not realise the testosterone drug was illegal.
He said he initially came into contact with these drugs when they were widely available from head shops.
Vilkys admitted that he and another man were planning to set up a website to distribute the drugs in Ireland.
He had come to Ireland nine years previously having qualified as an engineer in Lithuania.
Gda Hunt agreed with Remy Farrell SC, defending, that his client admitted he had set up an email address already, and he and another man had pooled money to set up a website to distribute the drugs.
